In our position paper, crafted in coalition with organizations like Creative Commons, Eleuther AI, GitHub, LAION, and Open Future, we put forth several recommendations aimed at enhancing the act’s effectiveness while ensuring it supports open-source development. Here are our five key suggestions:

  1. Define AI Components Clearly: A clear definition of AI components is crucial to avoid ambiguity in the regulation. This clarity will help developers understand what falls under the scope of the act and facilitate compliance without stifling innovation.

  2. Clarify Developer Exemptions: It is essential to clarify that collaborative development of open-source AI components and their availability in public repositories should not subject developers to the stringent requirements of the AI Act. This aligns with the Parliament’s text, particularly Recitals 12a-c and Article 2(5e), which emphasize the importance of open-source contributions.

  3. Support Inclusive Governance: The establishment of an AI Office that coordinates with the open-source ecosystem is vital. By fostering inclusive governance, the EU can ensure that the voices of open-source developers are heard and considered in the regulatory process.

  4. Practical R&D Exceptions: The research and development (R&D) exception in the act should be practical and effective. This includes allowing limited testing of AI systems in real-world conditions, which can enhance the reliability and applicability of AI technologies. A combination of the Council’s approach and an amended version of the Parliament’s Article 2(5d) could serve this need.

  5. Proportional Requirements for Foundation Models: Recognizing the distinct uses and development modalities of "foundation models" is crucial. By setting proportional requirements that account for open-source approaches, the act can better facilitate innovation while maintaining safety and ethical standards. Tailoring the Parliament’s Article 28b to reflect these nuances is recommended.

Transparency in AI development is not just a regulatory requirement; it is a fundamental principle that fosters accountability and trust. At Hugging Face, we strive to enhance transparency through comprehensive documentation and accessible ML artifacts. Our commitment to education and large-scale multidisciplinary collaborations further supports this goal, creating an environment where developers can not only create but also understand the implications of their work.
