When Can Power Companies Seize Private Land for Data Center Development?

The artificial intelligence (AI) landscape in the United States is evolving rapidly, driven by technological advancements that have sparked significant investment and development. This surge in AI is significantly intertwined with an accompanying building boom in data centers. Current estimates from the Pew Research Center indicate that there are over 3,000 data centers across the U.S., with another 1,500 currently in development. These centers serve as the cornerstone for processing vast amounts of data, making them essential for technologies like large language models, including ChatGPT.

Despite the enthusiasm for AI, a notable portion of the public remains wary. Polls reveal that roughly 70% of Americans are opposed to the construction of AI data centers in their communities. The concerns primarily revolve around the higher utility bills, pollution, noise, and potential loss of green space that these facilities generate. Furthermore, the considerable amounts of water and electricity used by data centers have raised alarm bells among residents regarding sustainability and resource management.

Opposition and the Challenges of Infrastructure

As the demand for data processing increases, the need for supporting infrastructure grows as well. This includes the critical transmission lines necessary to supply power to these energy-intensive facilities. As such, many companies face significant opposition when attempting to expand this infrastructure, primarily due to issues stemming from land acquisition. Land necessary for building transmission lines often intersects with private property, leading to disputes that can escalate to the use of eminent domain—a controversial governmental power to seize private property without the owner’s consent for public use.

Defining Eminent Domain

Eminent domain allows government entities and certain private companies to acquire private land when owners refuse to sell. According to the Fifth Amendment of the U.S. Constitution, land can be taken for public use as long as the landowner is compensated fairly. While the federal government can initiate eminent domain proceedings, most actions are undertaken by state and local authorities. Additionally, some states have their own laws that govern how this power is applied, which can vary significantly across the country.

For example, the Texas Supreme Court has ruled that a project must serve the public interest and cannot be intended solely for the private benefit of the builder. This highlights the varying standards that can influence whether a data center project qualifies for the use of eminent domain.

The ‘Public Use’ Standard and Its Implications

One of the most crucial components of eminent domain lies in the interpretation of “public use.” Historically, the U.S. Supreme Court has adopted a broad interpretation of this requirement. In the well-known case of Kelo v. City of New London (2005), the Court ruled that economic development could qualify as public use, allowing the seizure of homes to facilitate private development. However, the subsequent backlash led to reforms in many states aimed at restricting how eminent domain can be exercised, particularly when it benefits private entities.

State-specific interpretations of eminent domain laws can further complicate matters. For instance, some state supreme courts, such as those in Michigan and Ohio, have prohibited using eminent domain to transfer private land solely for economic development purposes, providing more leverage for private landowners against such actions.

The Future of Data Center Expansion

The use of eminent domain in cases involving data centers and their supporting infrastructure presents a complex legal landscape. Courts have generally upheld the exercise of eminent domain by utility companies, notably in states like South Dakota and Vermont, where providing energy to local customers has been deemed a valid public use. However, complications arise when transmission lines are intended to serve out-of-state customers, as highlighted in a 1984 case where a proposed line running from Mississippi to Louisiana was disallowed.

This sets up a dichotomy where landowners may have a legitimate avenue to challenge the takeovers if it can be shown that benefits do not extend to in-state customers. Additionally, as the demand for energy continues to escalate due to the proliferation of data centers, the debates surrounding infrastructure development, public use definitions, and property rights are likely to intensify.

Thus, as more data centers proliferate, the balance between technological advancement and community interests will remain a critical focal point in discussions about future developments and energy needs.
