Sixth Circuit Court Ruling: Implications for Net Neutrality and the FCC’s Authority

On January 2, 2024, the US Sixth Circuit Court of Appeals made waves in the realm of telecommunications law by issuing a ruling that challenges the outgoing Biden administration’s net neutrality regulations. By determining that the Federal Communications Commission (FCC) lacks the statutory authority to oversee broadband providers as common carriers, the court has set the stage for a significant shift in how internet services are regulated in the United States.

The crux of the court’s decision rests on an analysis of the Communications Act of 1934 and its later amendments. The Sixth Circuit found that Broadband Internet Service Providers (BISPs) offer only an "information service" under 47 U.S.C. § 153(24). This classification takes them outside the purview of the FCC’s authority to impose net neutrality policies, which would typically apply to "telecommunications services" as defined by § 153(51). The ruling also invalidated the FCC’s attempts to classify mobile broadband as a "commercial mobile service," concluding that it fails to meet the statutory requirements for interconnection with the "public switched network."

Judge Richard Griffin, in the unanimous opinion of the panel, underscored the legal rationale by stating, "We see nothing in the statute that permits the FCC to effectively change the statute’s original meaning…by adding ‘public IP addresses’ to adapt to new technology." This marked a clear limitation on the FCC’s regulatory powers regarding internet service providers.

The court’s decision invalidates the FCC’s 2024 Safeguarding and Securing the Open Internet Order, which sought to reinstate regulations from 2015 that were dismissed in a 2017 rollback. In August 2024, a federal appeals court had already blocked the implementation of the new rules, reflecting ongoing confusion and legal battles surrounding net neutrality. Central to this most recent appellate court decision is the Supreme Court’s 2024 ruling in Loper Bright, which fundamentally changed the landscape by overturning the Chevron doctrine. The Chevron doctrine previously allowed courts to defer to federal agencies’ interpretations of laws. Following Loper Bright, the Sixth Circuit took a firmer stance, conducting its own analysis of the Communications Act instead of deferring to the FCC.

Current FCC Chairwoman Jessica Rosenworcel called for lawmakers to take action, highlighting consumer demand for a “fast, open, and fair” internet. Her statement on Bluesky suggests legislative action as a necessary immediate response to the growing concerns over internet access and equity.

Despite the unlikelihood of swift legislative progress, the call for Congressional intervention underscores a persistent frustration among advocates of net neutrality. Consumers are increasingly vocal about their desire for a free and open internet—an issue likely to remain at the forefront as political dynamics continue to evolve.

The implications of the Sixth Circuit’s ruling extend far beyond the courtroom. As the debate over net neutrality and internet service regulation continues, it becomes increasingly critical for stakeholders, consumers, and lawmakers to engage in discussions about the future of the internet. The absence of clear regulatory frameworks raises questions about the access and equity of online services, making this issue a priority for many across the political spectrum.

As we move forward into an uncertain regulatory landscape, the balance between consumer rights, industry interests, and legislative action will play a pivotal role in shaping the future of internet access in the United States. With the courts and Congress now involved, the debate over net neutrality is far from over.
